1. Acceptance of Terms
By accessing or using CertiLab, you agree to be bound by these Terms and any posted policies. If you do not agree, please do not use our platform.
2. Eligibility and Scope
You must be at least 16 years old (or older, as required by your jurisdiction) to use CertiLab. These Terms apply globally to all users, irrespective of country. For minors, parental consent may be required as per local law.
3. Use License
CertiLab grants you a limited, non-exclusive, non-transferable right to access and use the platform for personal, non-commercial purposes. You may not:
- Modify, copy, or redistribute materials.
- Use for commercial or public purposes without permission.
- Reverse engineer, probe, or decompile any software or algorithm.
- Remove copyright or propriety notices.
- Transfer materials or “mirror” to other servers.
4. User Accounts
You must provide accurate, complete, and up-to-date information to register. Safeguard your password and are responsible for all activities on your account. Notify us immediately of any unauthorized use or security breach.
5. Test Content, Results, and Certification Disclaimer
All materials, questions, and results are provided for educational purposes. Unless specifically stated, results or certificates are not official professional certifications. CertiLab doesn’t guarantee success or official recognition.
6. Prohibited Activities
- Cheating, sharing answers, or collaborating during assessments unless authorized.
- Automating access (bots/scripts) or scraping platform data.
- Attempting unauthorized access, bypassing restrictions, or interfering with platform operations.
- Uploading viruses/malware or engaging in fraudulent or abusive behavior.
- Impersonating any person or entity, or misrepresenting your affiliation.
7. Intellectual Property
All content, code, features, and services are owned or licensed by CertiLab and protected by applicable laws. No licenses or rights are granted beyond those expressly outlined herein.
8. Termination and Suspension
We reserve the right to suspend, terminate, or restrict your account or access at any time, for conduct violating these Terms or applicable laws. Upon termination, your rights to use the platform cease, and we may delete your account/data subject to legal/regulatory obligations.
9. Portability and Switching (EU Data Act)
Users within the EU/EEA may request to export their test data and records, and switch to another service or provider per applicable law. CertiLab will facilitate reasonable migration and provide data formats as required.
10. Limitation of Liability
CertiLab is not liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to your use of the service, except in case of willful misconduct or gross negligence as required by law.
11. Disclaimer of Warranties
The service is provided “as is” and “as available.” CertiLab makes no warranties, express or implied, regarding accuracy, reliability, or suitability for any purpose. Use at your own risk.
12. Indemnification
You agree to indemnify and hold harmless CertiLab, its affiliates, staff, and partners from any claims, liabilities, damages, losses, or expenses arising from your violation of these Terms or applicable law.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of Spain and the EU, except where local law provides otherwise. Any dispute will be resolved in courts of competent jurisdiction, with English as the working language unless otherwise required.
14. Business Transfers/Assignment
If CertiLab is involved in a merger, acquisition, sale, or transfer of assets, your account and associated rights/obligations may transfer to a successor entity in compliance with applicable notice requirements.
15. Changes to Terms and Notification
We may update, revise, or replace these Terms periodically. Material changes will be notified by email or prominent notice at least 30 days prior to taking effect. Continued use after changes constitutes agreement to the new Terms.
